A tax dispute between The Rise Golf Course and the City of Vernon has gone to court.
The Rise Golf Course and Rencor Investments are suing the City of Vernon over a big property tax bill.
The notice of civil claim was filed in B.C. Supreme Court on July 5.
In a statement of claim, lawyers for The Rise Golf Course (RGC) dispute an outstanding tax bill of $187,214.66 for land that comprises part of the golf course and The Rise housing development.
The lands in question were purchased by RGC in 2014 following a foreclosure proceeding against the former owner.
According to the court document:
- following a query, the City of Vernon provided RGC with information showing the 2014 property taxes on the land totalled $32,690.40
- the City issued a property tax notice to RGC in June, 2015 of $32,690.40
- a month later, the City advised it made an error and issued a tax notice that almost tripled the amount owed to $97,194.59
The plaintiffs accuse the City of negligence and making false, inaccurate and/or misleading representations.
The golf course and its owners state they have suffered loss and damage due to overpayment of lands and increased tax liability. They are asking for general and special damages.
